General Terms and Conditions of Naoimi
§ 1 Scope
(1) These General Terms and Conditions (Terms) apply to all orders placed by consumers and businesses through the Naoimi online shop.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB).
§ 2 Contracting party
The purchase contract is concluded with: Aliya Woitinek, Naoimi, c/o IP-Management #45986, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany, email: naoimishop@gmail.com. Further details can be found in our Legal Notice.
§ 3 Conclusion of the contract
(1) The presentation of products in the online shop is not a legally binding offer but a non-binding invitation to place an order.
(2) By clicking the order button, you place a binding order for the items in your shopping cart. You can review and correct your details at any time before submitting.
(3) Immediately after ordering, you will receive an automatic email confirming receipt of your order. With this order confirmation we accept your offer, and the purchase contract is concluded.
§ 4 Contract language and contract text
The contract languages are German and English. We store the contract text. We will send you the order details and these Terms by email with the order confirmation. You can view these Terms on this page at any time.
§ 5 Prices and shipping costs
(1) All prices are final prices in euros. As a small business within the meaning of § 19 of the German VAT Act (UStG), we do not charge VAT and therefore do not show it.
(2) Shipping costs are added and are shown before you complete your order. Current shipping costs can be found on our Shipping page.
(3) For deliveries to countries outside the European Union, customs duties, taxes and fees may apply, which are paid by the recipient.
§ 6 Payment
The available payment methods are shown during checkout. Payment is due when the order is placed.
§ 7 Delivery
(1) We deliver to Germany, the European Union and the other countries shown during checkout.
(2) Estimated delivery times can be found on our Shipping page. They begin when payment is received.
§ 8 Retention of title
The goods remain our property until paid in full.
§ 9 Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in our Right of Withdrawal information.
§ 10 Voluntary 30-day return policy
(1) In addition to the statutory right of withdrawal, we voluntarily grant a return right of 30 days from receipt of the goods, provided the goods are returned unworn and in their original condition.
(2) You bear the cost of return shipping.
(3) Your statutory right of withdrawal and your statutory warranty rights remain unaffected.
§ 11 Warranty
Statutory warranty rights apply.
§ 12 Liability
(1) We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, and under the German Product Liability Act.
(2) In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical for the contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely.
(3) Otherwise, liability for slight negligence is excluded.
§ 13 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 14 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.
(2) Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
